1. Program Overview

These Terms and Conditions govern your participation in Momentum Dietetics’ Online Nutrition Small Group Weekly Program (“the Program”).

Program Inclusions:

  • 15-minute intake call prior to joining the group
  • Completion of intake survey (mandatory)
  • Access to online message group
  • Weekly video calls with the group
  • Weekly PDF nutrition resources
  • Q&A support from qualified practitioners
  • Group support and accountability

2. Enrolment and Payment
2.1 Enrolment Process

To enrol in the Program, you must:

  • Complete the intake survey provided at the time of registration
  • Participate in a 15-minute intake call to assess suitability for the Program
  • Make your first payment to confirm your place in the group

We reserve the right to decline enrolment if we determine the Program is not suitable for your needs.

2.2 Program Fee

The Program fee is $25 per week, payable weekly in advance via Stripe.

2.3 Payment Terms
  • Payment is due weekly on the same day of the week as your initial purchase date (e.g., if you sign up on a Tuesday, payments will be due every Tuesday thereafter)
  • Payments will be processed automatically via Stripe
  • Failed payments may result in suspension of Program access until payment is received
2.4 Promotional Offers

From time to time, we may offer promotional coupons or discounts. These are subject to specific terms communicated at the time of the offer.

3. Program Access and Participation
3.1 Access

Upon successful completion of the intake process and payment, you will receive access to:

  • The private online message group platform
  • Weekly video call links and schedules
  • Digital resources via email or the message group
3.2 Participation Requirements
  • You must provide accurate contact information for Program communications
  • You must complete the intake survey truthfully and disclose all relevant health information
  • You are responsible for maintaining the confidentiality of any login credentials
  • You agree to participate respectfully and constructively with other group members
3.3 Group Conduct

Participants must:

  • Respect the privacy and confidentiality of other group members
  • Refrain from sharing personal information of others outside the group
  • Engage in supportive, non-judgmental communication
  • Not share Program materials (PDFs, video recordings, resources) with non-participants

4. Intellectual Property
4.1 Ownership

All Program materials, including but not limited to PDFs, video content, written resources, and proprietary methods, remain the intellectual property of Momentum Dietetics.

4.2 Permitted Use

You may use Program materials for your personal nutrition and health purposes only. You may not:

  • Reproduce, distribute, or share materials with third parties
  • Use materials for commercial purposes
  • Record or screenshot video calls without express permission

5. Health and Professional Advice
5.1 Nature of Service

The Program provides general nutrition education, support, and guidance. It is not a substitute for individualised medical or dietary advice.

5.2 Your Responsibility
  • You are responsible for consulting with your GP or healthcare provider before making significant dietary changes
  • You must disclose any relevant medical conditions, allergies, or dietary restrictions during the intake process
  • You acknowledge that results may vary and are not guaranteed
  • You must inform us immediately if your health circumstances change during the Program
5.3 Limitation of Liability

Momentum Dietetics is not liable for any adverse health outcomes resulting from your participation in the Program. You participate at your own risk.

6. Cancellation and Refunds
6.1 Your Cancellation Rights

You may cancel your participation in the Program at any time by providing 7 days’ written notice to hello@momentumdietetics.com.au.

6.2 Refund Policy
  • Cancellations made with 7 days’ notice will cease future billing
  • No refunds will be provided for weeks already paid
  • Refunds for unused weeks may be provided in exceptional circumstances at our sole discretion, including:
  • Serious illness or medical emergency preventing participation (medical certificate required)
  • Unexpected relocation or life circumstances beyond your control
  • Program cancellation or significant changes by Momentum Dietetics
  • Technical issues on our end preventing access to the Program for an extended period
  • Refund requests must be submitted in writing with supporting documentation
  • Refunds will be processed within 14 business days of approval
6.3 Our Right to Terminate

We reserve the right to terminate your participation if you:

  • Breach these Terms and Conditions
  • Engage in disruptive or disrespectful behaviour
  • Fail to make payment when due
  • Provide false or misleading information during the intake process

In such cases, no refund will be provided.

7. Privacy and Confidentiality
7.1 Personal Information

We collect and handle your personal information (including health information collected during the intake process) in accordance with our Privacy Policy, available at momentumdietetics.com.au.

7.2 Group Confidentiality

Information shared within the group (including personal stories, health information, and progress) must be kept confidential by all participants.

8. Changes to the Program
8.1 Program Modifications

We reserve the right to modify the Program structure, schedule, or content with reasonable notice to participants.

8.2 Changes to Terms

We may update these Terms and Conditions from time to time. Continued participation after changes constitutes acceptance of the updated terms.

9. Technical Requirements and Limitations
9.1 Your Responsibility

You are responsible for:

  • Maintaining internet access and compatible devices
  • Ensuring your technology meets the requirements for video calls and message group access
9.2 Technical Issues

We are not liable for technical difficulties, internet outages, or platform issues that prevent your participation. No refunds will be provided for missed sessions due to technical problems on your end.

10. Dispute Resolution
10.1 Complaints

If you have a complaint or concern, please contact us at hello@momentumdietetics.com.au. We will make reasonable efforts to resolve the matter promptly.

10.2 Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.

11. Acknowledgement and Acceptance

By enrolling in the Program and making payment, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
