1. Acceptance of Terms

By purchasing and participating in the Momentum Holistic Health Coaching Program (“Program”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not proceed with this Program.

3. Program Description

The Momentum Holistic Health Coaching Program is a five (5) session coaching program designed to provide science-backed support integrating mindset, mental health, sleep, and nutrition to help you perform at your best.

3.1 Program Structure

The Program consists of five approximately 15-minute holistic health coaching sessions delivered as follows:

  • Session 1: Mindset & Nutrition – Getting to know your coach, setting expectations, exploring goals, and establishing practical take-home actions
  • Session 2: Mental Health & Nutrition – Understanding how mental wellbeing influences eating habits using evidence-based tools and reflection
  • Session 3: Sleep & Nutrition – Understanding how quality sleep impacts recovery, metabolism, and overall health, plus optimisation strategies
  • Session 4: Nutrition Deep Dive – Exploring key nutrition principles and tailoring them to your individual goals and lifestyle
  • Session 5: Recap & Next Steps – Reviewing progress, refining strategies, and mapping out long-term success
3.2 Recommended Timeframe

For maximum effectiveness on habit and behaviour change, this Program is recommended to be completed within a 10-day block. You may skip 1-2 days as schedules permit while maintaining consistency.

3.3 Session Duration Flexibility

While sessions are scheduled for approximately 15 minutes, actual session duration may vary (shorter or longer) depending on:

  • Your individual needs and questions
  • The natural flow of the consultation
  • Topics requiring deeper exploration
  • Your coach’s professional determination of appropriate session length
4. Nature of Service

IMPORTANT: This Program provides:

  • Holistic health coaching focused on nutrition, mindset, mental health, and sleep
  • Evidence-based education and practical strategies
  • Accountability and support for behaviour change
  • Goal-setting and progress tracking
  • Science-backed advice tailored to your lifestyle

This Program does NOT provide:

  • Medical advice, diagnosis, or treatment
  • Mental health counselling or psychological therapy
  • Treatment for diagnosed mental health conditions
  • Medical nutrition therapy for clinical conditions
  • Emergency mental health support
  • Personalised meal plans (unless specifically included in your package)
  • Medication advice or management
5. Pricing and Payment Terms
5.1 Program Fee

The standard fee for this Program is $320 AUD (including GST where applicable).

5.2 Payment Due

Full payment of $320 is required at the time of booking to secure your place in the Program.

5.3 Accepted Payment Methods

We accept payment via:

  • Credit card
  • Debit card
  • Bank transfer (upon prior arrangement)
  • Other methods as communicated at the time of booking
5.4 Promotional Coupons and Discounts

From time to time, we may offer promotional coupons, discount codes, or special pricing for marketing purposes.

Coupon Terms:

  • Coupons must be applied at the time of purchase
  • Only one coupon or discount code may be used per purchase
  • Coupons cannot be combined with other offers unless explicitly stated
  • Coupons have expiry dates and must be redeemed before expiry
  • We reserve the right to verify coupon validity and refuse redemption of invalid, expired, or fraudulently obtained coupons
  • Coupons have no cash value and cannot be exchanged for cash or credit
  • Promotional pricing is subject to availability and may be withdrawn at any time
5.5 Payment Confirmation

Upon successful payment, you will receive:

  • A payment confirmation email
  • Receipt/tax invoice
  • Access to book your first session
5.6 Failed or Declined Payments

If payment is declined or fails:

  • Your booking will not be confirmed
  • You will be notified and given the opportunity to provide alternative payment
  • Your place in the Program is not secured until payment is successfully processed
5.7 Price Changes

We reserve the right to change our pricing at any time. Price changes will not affect bookings already paid for in full.

6. Refund and Cancellation Policy
6.1 Cancellation Before First Session

If you wish to cancel before your first session:

  • You must provide notice at least 48 hours before your scheduled first session
  • You will receive a full refund of $320
  • Cancellations with less than 48 hours’ notice are non-refundable
6.2 Cancellation After First Session

Once you have attended your first session:

  • The Program fee is non-refundable
  • You may withdraw from the Program at any time, but no refund will be provided
  • Unused sessions cannot be transferred, credited, or refunded
6.3 Individual Session Cancellations

If you need to cancel or reschedule individual sessions during the Program:

  • Provide at least 24 hours’ notice
  • Sessions cancelled with less than 24 hours’ notice will be counted as completed
  • Emergency situations will be considered on a case-by-case basis
  • See Section 9 for full cancellation and rescheduling policy
6.4 Non-Completion Within Timeframe

If you fail to complete all 5 sessions within 10 days of your first session:

  • Any unused sessions will expire with no refund
  • No extensions or credits will be provided
  • See Section 8.4 for maximum completion period details
6.5 Refunds for Service Provider Cancellation

If we cancel your Program or cannot deliver the service:

  • You will receive a full refund of $320
  • Or you may reschedule to a future Program date
6.6 Processing of Refunds

Approved refunds will be:

  • Processed within 5-10 business days
  • Refunded to the original payment method used for purchase
  • Subject to any processing fees charged by payment providers (if applicable)
6.7 Australian Consumer Law

Nothing in this refund policy excludes or limits your rights under the Australian Consumer Law, including your rights to a refund for services that are not delivered or are not of acceptable quality.

7. Eligibility and Restrictions
7.1 Target Audience

This Program is designed for generally healthy individuals seeking to:

  • Improve their overall health and wellness
  • Develop sustainable nutrition and lifestyle habits
  • Enhance performance in training and daily life
  • Better understand connections between mindset, sleep, and nutrition
7.2 Not Appropriate For

This Program is not appropriate for individuals:

  • Currently experiencing acute mental health crisis or suicidal ideation
  • Requiring clinical psychological or psychiatric treatment
  • With diagnosed eating disorders (anorexia nervosa, bulimia nervosa, binge eating disorder)
  • With severe medical conditions requiring specialist medical supervision
  • With complex mental health conditions requiring clinical intervention
  • Seeking treatment for diagnosed psychiatric conditions
7.3 Medical Conditions

If you have any diagnosed medical or mental health conditions, you must:

  • Disclose these to your coach before commencing the Program
  • Obtain clearance from your treating healthcare provider to participate
  • Continue under the care of appropriate medical professionals
  • Understand this Program is educational and supportive, not therapeutic
7.4 Mental Health Content

While this Program includes discussion of mental health and wellbeing, it is not a substitute for mental health treatment. If you are experiencing mental health difficulties, please seek appropriate support from:

  • Your GP
  • A registered psychologist or psychiatrist
  • Mental health crisis services (Lifeline 13 11 14, Beyond Blue 1300 22 4636)
8. Informed Consent Requirement
8.1 Mandatory Consent Form

Before commencing the Program, you must:

  • Complete and return the informed consent form provided by Momentum Dietetics
  • Disclose relevant health information, including medical conditions, medications, and mental health history
  • Acknowledge your understanding of the Program’s scope and limitations
8.2 Consequence of Non-Completion

Failure to complete and return the informed consent form will result in:

  • Inability to commence the Program
  • No sessions scheduled until the form is received
  • Your first session appointment may be rescheduled

Note: Your payment is still subject to the refund policy in Section 6. If you do not submit your consent form and wish to cancel, the cancellation timeframes in Section 6.1 apply.

8.3 Accuracy of Information

You warrant that all information provided in the informed consent form is:

  • True, accurate, and complete to the best of your knowledge
  • Updated if your circumstances change during the Program
9. Booking and Scheduling
9.1 Initial Booking

After completing your payment, you may book your first session. You will need to submit your informed consent form before your first session and email it back to us to confirm your attendance.

9.2 Subsequent Sessions

Ongoing sessions are typically scheduled:

  • At the end of each previous session via an online booking calendar, OR
  • Via email coordination with your coach
9.3 Recommended Completion Timeframe

We strongly recommend completing all 5 sessions within a 10-day block for optimal habit formation and behaviour change outcomes.

9.4 Maximum Completion Period

The Program must be completed within 10 DAYS of your first session. After this period, any unused sessions expire with no option to reschedule or refund.

9.5 Commitment to Attendance

By purchasing this Program, you commit to attending all scheduled sessions. Failure to attend may result in forfeiture of your investment with no refund.

10. Cancellation and Rescheduling
10.1 Your Cancellation/Rescheduling

If you need to cancel or reschedule a session:

  • Provide at least 24 hours’ notice to allow your coach to manage their schedule
  • Cancellations with less than 24 hours’ notice will be counted as a completed session
  • Emergency situations will be considered on a case-by-case basis
10.2 Repeated Cancellations

If you cancel or reschedule more than twice, we reserve the right to:

  • Count additional cancellations as completed sessions
  • Require you to complete remaining sessions within the original 10-day timeframe with no extensions
10.3 Coach Cancellation

If your coach needs to cancel or reschedule:

  • You will be given as much notice as possible
  • You will be offered an alternative time at no additional cost
  • No session will be counted as used due to coach cancellation
  • Your 10-day completion period may be extended in circumstances where multiple coach cancellations impact your ability to complete within the original timeframe
10.4 No-Show Policy

If you fail to attend a scheduled session without notice:

  • That session will be counted as completed with no refund
  • Repeated no-shows may result in forfeiture of remaining sessions
  • No refund will be provided for missed sessions
11. Withdrawal from Program
11.1 Your Right to Withdraw

You may withdraw from this Program at any time by notifying us via:

11.2 Refund Upon Withdrawal

Refunds upon withdrawal are subject to the Refund and Cancellation Policy in Section 6. Once you have attended your first session, no refund will be provided.

11.3 Effect of Withdrawal

Upon withdrawal:

  • All scheduled sessions will be cancelled
  • Access to any Program materials may be revoked
  • No refund will be provided for any completed or missed sessions
12. Your Responsibilities
12.1 Commitment and Participation

You agree to:

  • Attend all 5 scheduled sessions punctually
  • Complete the Program within the recommended 10-day timeframe where possible
  • Actively participate in discussions and activities
  • Complete any assigned take-home actions or reflections
  • Provide honest and accurate information to your coach
12.2 Value of Investment

Given your financial investment in this Program, you agree to:

  • Value and respect your coach’s time
  • Provide adequate notice for cancellations
  • Participate in good faith
  • Take responsibility for maximising your outcomes
12.3 Communication

You agree to:

  • Respond to booking and scheduling communications promptly
  • Notify your coach of any changes to your health status
  • Disclose any difficulties or concerns during the Program
  • Maintain professional and respectful communication
12.4 Self-Care

You agree to:

  • Take responsibility for your own health and wellbeing
  • Seek medical advice for any health concerns
  • Not rely solely on this Program for mental health support
  • Discontinue participation if you feel the Program is not suitable
13. Coach Responsibilities
13.1 Professional Standards

Your coach will:

  • Provide evidence-based information and guidance
  • Maintain appropriate professional boundaries
  • Respect your privacy and confidentiality
  • Tailor the Program to your individual needs within the scope of the sessions
13.2 Scope Limitations

Your coach will not:

  • Provide medical advice or diagnose conditions
  • Offer psychological therapy or counselling
  • Prescribe meal plans for medical conditions outside their scope
  • Continue working with you if the Program is beyond their professional scope
13.3 Referrals

If your coach determines that your needs are beyond the scope of this Program, they will refer you to appropriate healthcare professionals. This does not entitle you to a refund unless you have not yet attended your first session (see Section 6.1).

14. Disclaimer and Limitations
14.1 Educational Nature

This Program is educational and supportive in nature. All information provided is for general educational purposes and should not replace professional medical or mental health advice.

14.2 Individual Results

Results from this Program vary between individuals. Momentum Dietetics makes no guarantee of specific outcomes, including but not limited to:

  • Weight loss or body composition changes
  • Improved sleep quality or duration
  • Enhanced mental wellbeing or mood
  • Behaviour change success
  • Performance improvements
14.3 Participant Responsibility

Success in this Program depends largely on your:

  • Active participation and engagement
  • Willingness to implement strategies discussed
  • Consistency in attendance and follow-through
  • Individual circumstances and health status
14.4 Mental Health Content

Discussion of mental health topics is for educational purposes only and does not constitute mental health treatment. If you experience worsening mental health symptoms, please seek appropriate professional support immediately.

14.5 No Warranties

To the extent permitted by law, this Program is provided “as is” without warranties of any kind, either express or implied, including but not limited to:

  • Accuracy or completeness of information provided
  • Suitability for your specific needs
  • Error-free or uninterrupted service delivery
  • Specific outcomes or results
15. Confidentiality and Privacy
15.1 Information Collection

We collect and process personal information including:

  • Contact details (name, email, phone number)
  • Payment and billing information
  • Health information disclosed in the informed consent form
  • Information shared during coaching sessions
  • Progress notes and session records
  • Feedback about your experience with the Program
15.2 Use of Information

Your information is used to:

  • Process your payment and maintain financial records
  • Deliver the coaching program effectively
  • Track your progress and goals
  • Communicate with you about the Program
  • Improve our services
  • Comply with legal and professional obligations
  • Send information about our other services (with your consent)
15.3 Confidentiality

All information you share remains confidential except where:

  • You provide explicit consent to share information
  • We are legally required to disclose information
  • There is risk of harm to yourself or others
  • Professional supervision or consultation is required (information de-identified where possible)
15.4 Data Security

We implement reasonable security measures to protect your personal and health information in accordance with the Privacy Act 1988 (Cth) and Australian Privacy Principles.

16. Communication and Marketing
16.1 Program Communications

By participating in this Program, you agree to receive communications necessary for service delivery via email, SMS, or phone.

  • Extended health coaching packages
  • Specialised nutrition programs
  • Workshops and group programs
16.3 Opt-Out

You can opt out of marketing communications at any time by:

16.4 Feedback Requests

All content, resources, and materials provided as part of this Program remain the intellectual property of Momentum Dietetics, including:

  • Session content and structure
  • Handouts and worksheets
  • Educational materials
  • Frameworks and methodologies
17.2 Personal Use Licence

You are granted a personal, non-transferable licence to use Program materials for your own personal use only.

17.3 Restrictions

You may not:

  • Reproduce or distribute Program materials publicly
  • Use materials for commercial purposes
  • Share materials with third parties
  • Teach or coach others using our proprietary methods
  • Remove copyright or proprietary notices
18. Limitation of Liability
18.1 General Limitation

To the maximum extent permitted by law, Momentum Dietetics and its health coaches, employees, and contractors are not liable for:

  • Any loss, damage, or injury arising from participation in this Program
  • Decisions you make based on information provided in coaching sessions
  • Any health outcomes or changes resulting from the Program
  • Worsening of pre-existing health or mental health conditions
  • Indirect, consequential, or special damages
18.2 Maximum Liability

To the extent our liability cannot be excluded by law, our maximum liability to you for any claim arising from or in connection with this Program is limited to the amount you paid for the Program ($320).

18.3 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies under the Australian Consumer Law or other applicable laws that cannot be lawfully excluded.

18.4 Professional Indemnity

Our health coaches maintain appropriate professional indemnity insurance for services provided within their scope of practice.

19. Termination
19.1 Your Right to Withdraw

You may withdraw from this Program at any time. See Section 11 for details. No refund will be provided after your first session.

19.2 Our Right to Terminate

We reserve the right to terminate your participation in the Program if:

  • You breach these Terms and Conditions
  • You engage in abusive, threatening, or inappropriate behaviour toward staff
  • You provide false or misleading information
  • Your needs are beyond the scope of this Program
  • You fail to attend scheduled sessions without notice (repeated no-shows)
  • We determine continued participation poses risks to your health or wellbeing
  • You do not complete and return the required informed consent form
  • Payment is reversed, charged back, or disputed
19.3 Effect of Termination

Upon termination:

  • All scheduled sessions will be cancelled
  • Your access to Program materials may be revoked
  • No refund will be provided (except as required under Section 6 or Australian Consumer Law)
19.4 Refund Upon Our Termination

If we terminate your participation for reasons other than your breach of these Terms:

  • You may be entitled to a pro-rata refund for unused sessions
  • This will be assessed on a case-by-case basis
20. Transition to Additional Services
20.1 Continuing Your Journey

Upon completion of this Program, you may wish to continue with:

  • 60-minute Initial Dietitian Consultation – Comprehensive assessment and personalised nutrition advice
  • Ongoing Dietetic Consultations – Regular follow-up sessions for continued support
  • Extended Health Coaching Packages – Longer-term behaviour change programs
  • Specialised Nutrition Programs – Targeted programs for specific health goals or conditions
  • Group Coaching Programs – Cost-effective group-based nutrition and wellness coaching
20.2 No Obligation to Continue

Completion of this Program does not obligate you to:

  • Purchase any additional services
  • Continue with ongoing consultations
  • Enrol in other paid programs
20.3 Special Offers for Program Participants

Participants who complete all 5 sessions may be eligible for:

  • Discounted rates on initial consultations
  • Priority booking for ongoing services
  • Exclusive program packages
  • Early access to new services or group programs

Details of any special offers will be communicated during or after your final session.

20.4 Separate Terms Apply

Any additional services you choose to engage in will be subject to separate terms and conditions and payment agreements. Completion of this Program does not bind you to any future contracts.

21. Changes to Program
21.1 Right to Modify

Momentum Dietetics reserves the right to:

  • Modify the Program structure or content
  • Update session topics or duration
  • Change pricing for future participants
  • Change eligibility requirements
  • Discontinue the Program at any time
21.2 Notice of Changes

Where reasonably practicable, we will provide advance notice of any material changes to the Program.

21.3 Changes During Your Participation

If changes occur while you are actively participating:

  • Changes will not affect your purchased Program
  • You will complete your remaining sessions under the terms and structure agreed at the time of purchase
  • Material changes that prevent delivery of the service may entitle you to a refund
22. Dispute Resolution
22.1 Initial Resolution Attempts

If you have any complaints or concerns about this Program, you should first:

  • Raise the matter directly with your coach

  • Allow us a reasonable opportunity to address and resolve the issue
22.2 Formal Complaints Process

If informal resolution is unsuccessful, you may submit a formal written complaint to:

We will acknowledge your complaint within 2 business days and provide a substantive response within 10 business days.

22.3 External Dispute Resolution

If you remain dissatisfied after our internal complaints process, you may seek external resolution through:

  • Relevant professional bodies or associations
  • Consumer affairs or fair trading bodies in your state/territory
  • Alternative dispute resolution services
22.4 Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.

23. General Provisions
23.1 Entire Agreement

These Terms and Conditions, together with:

  • The informed consent form
  • Our Privacy Policy
  • Any additional program documentation

constitute the entire agreement between you and Momentum Dietetics regarding this Program.

23.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

23.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

23.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

23.5 Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including:

  • Natural disasters
  • Pandemics or public health emergencies
  • Government restrictions or lockdowns
  • Technology failures
  • Industrial action

In such circumstances, we will make reasonable efforts to reschedule sessions or provide alternative arrangements where possible.

23.6 Survival

Sections relating to payment, refunds, confidentiality, intellectual property, limitation of liability, dispute resolution, and general provisions survive termination or completion of this Program.

24. Acknowledgment and Acceptance

By purchasing and participating in the Momentum Holistic Health Coaching Program, you acknowledge that you have:

  • Read and understood these Terms and Conditions in full
  • Had the opportunity to seek independent legal advice if desired
  • Agreed to be bound by these Terms
  • Understood the scope and limitations of this Program
  • Agreed to the payment, refund, and cancellation terms
  • Committed to completing the informed consent form and disclosing relevant health information accurately

If you do not agree to these Terms and Conditions, please do not purchase or participate in this Program. Contact us to discuss refund options if you have already made payment.

CLIENT ACCEPTANCE
